1. Acceptance
By installing the True2Size app ("Service") from the Shopify App Store or by using the True2Size sizing widget on your store, you ("Merchant") agree to these Terms of Service ("Terms"). If you do not agree, do not install or use the Service.
These Terms apply between True2Size ("we", "us") and the Merchant. End-shoppers on your store are subject to the True2Size Privacy Policy.
2. Description of service
True2Size provides a sizing recommendation widget that Merchants embed on their online store. The widget collects body measurements entered by end-shoppers and returns a size recommendation based on the Merchant's size chart data.
Merchants can optionally enable a "Save my size" feature, allowing shoppers to create a cross-store size profile. This feature is governed by the True2Size Privacy Policy and requires shopper consent.
3. Merchant responsibilities
- You are responsible for providing accurate size chart data. True2Size recommendations are only as accurate as the size data you supply.
- You must not use the Service to collect data from individuals under 16 years of age.
- You must inform your shoppers that True2Size powers the sizing widget (the widget itself carries the True2Size branding).
- You must comply with applicable privacy laws (including GDPR and ePrivacy) as they apply to your store and your shoppers.
- You must not attempt to reverse-engineer, scrape, or resell the Service or data derived from it.
4. Shopper data and privacy
True2Size acts as a data processor for measurement and recommendation data collected through your store. We process this data solely to provide the Service. A Data Processing Agreement (DPA) is available on request at privacy@true-2-size.com.
Shopper size profiles saved with True2Size are controlled by the shopper (not the Merchant) and are subject to the True2Size Privacy Policy. Merchants do not have access to individual saved shopper profiles; only aggregate, anonymised analytics are made available to Merchants.
5. Intellectual property
True2Size retains all rights in the Service, including the widget code, sizing engine, and brand. You may not copy, modify, or redistribute any part of the Service.
You retain all rights in your size chart data. By uploading it, you grant True2Size a licence to use it solely to provide the Service to you.
6. Availability and support
We aim to keep the Service available at all times but do not guarantee uninterrupted availability. We may update, modify, or discontinue features of the Service with reasonable notice where possible.
Support is available via email at support@true-2-size.com. We aim to respond within 2 business days.
7. Pricing
The Service is currently provided free of charge. We reserve the right to introduce paid plans in the future. If we do, existing Merchants will receive at least 30 days' notice before any charges apply, and will have the option to discontinue use at no cost.
8. Limitation of liability
To the fullest extent permitted by law, True2Size shall not be liable for indirect, incidental, or consequential damages arising from use of the Service, including any returns, exchanges, or customer dissatisfaction arising from sizing recommendations.
Our aggregate liability for any claim relating to the Service shall not exceed the total fees paid by the Merchant to True2Size in the 12 months preceding the claim (which, during any free period, is zero).
9. Termination
Either party may terminate use of the Service at any time by uninstalling the app or by giving written notice. On termination, we will delete or anonymise your size chart data within 30 days, unless retention is required by law.
10. Governing law
These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent court in Amsterdam, the Netherlands.
11. Changes to these terms
We may update these Terms. Material changes will be communicated via email or an in-app notice at least 14 days before taking effect. Continued use of the Service after that date constitutes acceptance.
